Participation may include classes, clubs, workshops, tutoring, Open Studio activities, special events, competitions, performances, collaborative projects, and other Society programming.

Specific activities may have additional fees, requirements, safety procedures, or participation expectations. These will be communicated to families when applicable.

This Agreement establishes the general expectations, permissions, acknowledgments, and safety requirements applicable to Society participation.

Certain specialized programs, including Odyssey of the Mind, may require additional agreements because of their unique financial, competition, travel, or participation commitments.

  • Be taken seriously when asking for help.
  • Participate in an environment where adults are expected to maintain appropriate boundaries and follow Society safety procedures.

5. Acknowledgment of Inherent and Ordinary Risks

PARENT/GUARDIAN INITIALS: __________

I understand that participation in hands-on Society activities may involve risks including cuts, punctures, splinters, burns, pinches, falls, eye injuries, irritation or reactions to materials, and accidental contact with hand tools, powered equipment, heat sources, adhesives, electronics, art materials, construction materials, or other participants.

I understand that following safety rules, receiving appropriate instruction, using equipment correctly, and wearing required protective equipment can reduce but cannot eliminate all risks associated with these activities.

I understand that Society programming may include hands-on maker, construction, art, technology, costume, theatrical, and similar activities involving the tools, equipment, and materials described in this Agreement.

I voluntarily permit my child to participate in Society activities for which the Society determines my child is appropriately trained, supervised, and authorized.

Nothing in this Agreement authorizes the Society or its personnel to disregard applicable safety responsibilities or law.

6. Equipment Access & Safety

Signing this Agreement does not provide unrestricted permission for a participant to use every tool or piece of equipment available at the Society.

The Society determines which tools and equipment a participant may use based on factors including:

  • Age
  • Program
  • Maturity
  • Experience
  • Training
  • Demonstrated ability to follow safety procedures
  • The equipment involved
  • The activity being performed
  • The level of adult supervision available

Before using equipment requiring instruction, participants must receive appropriate safety instruction and demonstrate an understanding of the rules for its use.

The Society may require additional supervision, restrict how equipment may be used, or prohibit a participant from using particular equipment at any time.

Participants must immediately stop using equipment when directed by an instructor or Authorized Adult.

Participants agree to:

  • Follow all instructor and equipment-safety directions.
  • Use tools only for their intended purposes.
  • Wear required protective equipment.
  • Keep guards and other safety features in place.
  • Ask permission before using unfamiliar or restricted equipment.
  • Never use equipment they have not been authorized to use.
  • Report damaged or malfunctioning equipment.
  • Immediately report injuries or unsafe conditions.
  • Never use tools, equipment, or materials to threaten, intimidate, or intentionally harm another person.

Failure to follow equipment-safety requirements may result in immediate loss of tool or equipment privileges regardless of whether the participant remains enrolled in the program.

Special Activities

Some activities involving unusual or significantly increased risk may require additional information, safety requirements, or parent/guardian consent.

The Society will notify families when additional authorization is required.

7. Assumption of Risk, Release, and Indemnity

PARENT/GUARDIAN INITIALS: __________

I understand that participation in Society of Wit & Wonder programs may involve educational, recreational, artistic, theatrical, technological, maker, construction, costume, gaming, competition, and other hands-on activities. These activities may involve risks that cannot be completely eliminated even when reasonable safety precautions are used.

Such risks may include, without limitation, cuts, punctures, splinters, burns, falls, slips, trips, collisions, eye injuries, allergic or skin reactions, strains, sprains, broken bones, injuries involving tools or equipment, and other accidental injuries associated with ordinary participation in Society activities.

Assumption of Ordinary Risks

I acknowledge that I have reviewed the nature of Society programming described in this Agreement and voluntarily permit my child to participate in activities for which the Society determines my child is appropriately trained, supervised, and authorized.

On behalf of myself, and to the fullest extent permitted by Texas law, I knowingly and voluntarily assume the ordinary and inherent risks associated with my child’s participation in Society programming.

Release of Parent/Guardian Claims

To the fullest extent permitted by Texas law, I, in my individual capacity as parent or guardian, release and agree not to bring claims against the Society of Wit & Wonder, its directors, officers, employees, instructors, coaches, volunteers, contractors, agents, and authorized representatives for bodily injury, property damage, or other loss arising from the ordinary negligence of a released party in connection with my child’s participation in Society programming.

This release is intended to include claims based upon ordinary negligence involving supervision, instruction, use or condition of facilities, ordinary premises conditions, tools, equipment, supplies, activities, or program administration, to the fullest extent such claims may lawfully be released.

No Release of Claims That Cannot Lawfully Be Waived

Nothing in this Agreement is intended to release, waive, limit, or excuse liability for gross negligence, reckless or willful misconduct, intentional misconduct, abuse, or any other claim or duty that cannot lawfully be waived under Texas law.

Nothing in this Agreement is intended to waive a minor participant’s independent legal rights except to the extent Texas law expressly permits such a waiver.

Responsibility for Participant Conduct

I agree that my child will follow Society safety instructions, equipment rules, program requirements, and the Member Code of Conduct. I understand that unsafe conduct may result in immediate restriction from an activity or use of particular equipment.

To the fullest extent permitted by law, I accept responsibility for loss or damage caused by my child’s intentional misconduct or deliberate misuse of Society property, tools, equipment, or another person’s property.

Medical and Emergency Costs

I understand that I remain financially responsible for medical, dental, ambulance, hospital, or other treatment provided to my child arising from participation in Society activities, except to the extent another person or entity is legally responsible for those costs.

Severability

If any portion of this section is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Acknowledgment

I acknowledge that I have read this section, understand that participation may involve inherent and ordinary risks, have had the opportunity to ask questions, and voluntarily permit my child to participate subject to the terms of this Agreement.

The Society may photograph or record activities to celebrate participant work, communicate with families, share Society programs with the community, support fundraising, and tell the story of the Society.

Please select ONE:

Photographs or video of my child may be used in private Society, team, program, or family communications but should not intentionally be used in public promotional materials.

Please do not intentionally publish identifiable photographs or video of my child.

The Society will make reasonable efforts to honor each family's selection.

Families may update their media selection by notifying the Society according to its established registration procedures.

12. Society Memberships & Credits

This section applies to participants and households who purchase a Society membership.

The Society currently offers the following membership levels:

Explorer Membership

  • Two (2) Society Credits per month
  • Maximum accumulated credit balance of four (4) credits
  • Additional Society Credits available at the published Explorer rate

Maker Membership

  • Four (4) Society Credits per month
  • Maximum accumulated credit balance of eight (8) credits
  • Additional Society Credits available at the published Maker rate

Innovator Membership

  • Eight (8) shared household Society Credits per month
  • Maximum accumulated household credit balance of sixteen (16) credits
  • Additional Society Credits available at the published Innovator rate

The Innovator Membership is a household membership. Credits associated with an Innovator Membership may be used by eligible children within the same household.

Society Credits:

  • Have no cash value.
  • May be used only for eligible Society programming.
  • Are issued and used in whole-credit increments.
  • May accumulate from month to month only up to the maximum balance applicable to the selected membership level.
  • May be transferred between children within the same household, provided the applicable membership does not exceed its maximum allowable credit balance.
  • May not ordinarily be transferred between unrelated households.
  • Expire upon termination or expiration of the applicable membership.
  • Will be restored when the Society cancels an eligible program for which credits were used.

Unless otherwise published for a specific program, Society Credit requirements are based upon scheduled program length as follows:

  • Programs lasting up to seventy-five (75) minutes require one (1) Society Credit.
  • Programs lasting seventy-six (76) through one hundred fifty (150) minutes require two (2) Society Credits.
  • Programs lasting one hundred fifty-one (151) through two hundred ten (210) minutes require three (3) Society Credits.

Membership does not guarantee that every advertised class, club, workshop, event, or other program will operate. Programs may be subject to minimum enrollment, maximum capacity, instructor availability, scheduling requirements, facility limitations, or other reasonable operational considerations.

Open-room access is not a guaranteed membership benefit.

13. Membership Billing, Discounts & Cancellation

Society memberships may be offered on a monthly or quarterly basis.

Before purchase, the Society will publish the applicable membership price, billing frequency, included Society Credits, additional-credit rate, and any material terms applicable to the membership.

Quarterly memberships are prepaid for three consecutive months and may be offered at a discounted rate.

Current quarterly membership rates are:

  • Explorer Membership: $140
  • Maker Membership: $225
  • Innovator Membership: $425

The Society may offer household, sibling, volunteer, promotional, scholarship, or other approved discounts according to published terms.

The current sibling discount structure is:

  • Two children: ten percent (10%)
  • Three or more children: fifteen percent (15%)

Unless otherwise approved by the Society, the maximum standard household discount is fifteen percent (15%).

A household in which a parent or guardian actively serves on an approved Society committee may qualify for an additional volunteer discount. When such a discount applies, the maximum total household discount is twenty-five percent (25%).

Discount eligibility may require verification and continued satisfaction of the applicable eligibility requirements.

Quarterly membership pricing is already discounted and will be treated as a separate payment option rather than as an additional stackable discount unless the Society expressly provides otherwise.

A family may cancel a monthly membership before the next billing cycle according to the Society’s published cancellation process.

Cancellation ends future membership billing but does not create a cash refund for unused Society Credits.

Any unused Society Credits expire when the membership ends.

Quarterly membership payments are generally nonrefundable after the applicable quarterly term begins except when the Society approves an exception because of serious or extenuating circumstances.

Cancellation of a Society membership does not automatically cancel or eliminate financial obligations arising under a separate program agreement.

Certain programs, including Odyssey of the Mind, operate under separate participation and financial-commitment terms.

Nothing in this Agreement limits any cancellation, refund, or other consumer right that cannot lawfully be waived.

14. Program Fees, Materials & Additional Costs

Participation in certain Society programs may require fees or expenses in addition to membership dues or Society Credits.

Such costs may include:

  • Materials or supply fees
  • Registration fees
  • Tournament or competition fees
  • Travel expenses
  • Special-event fees
  • Additional Society Credits
  • Program-specific participation fees
  • Other clearly identified and disclosed costs

Applicable costs will be communicated before enrollment or before a family is asked to commit to the applicable expense.

Program-specific materials or supply fees are separate from general membership dues and are intended to support delivery of the applicable program.

The Society may permit families to provide their own approved materials in lieu of paying a published materials fee when the program structure allows.

When families provide their own materials, those materials must satisfy any applicable safety, compatibility, quantity, quality, or instructional requirements established for the program.

The Society may establish program-specific materials lists, budgets, limitations, or approval procedures based upon safety, cost, equipment, instructional needs, or other reasonable program considerations.

15. Program Cancellation, Withdrawal & Refunds

If the Society cancels a program, or if a program does not meet its minimum enrollment requirement and therefore does not proceed, the family will not forfeit the value paid or credits used for that program.

When Society Credits were used, the applicable credits will be restored to the participant’s or household’s account, subject to the terms of the applicable membership.

When a direct cash payment was made for the cancelled program, the payment will ordinarily be refunded or credited according to the applicable program terms.

If a participant voluntarily withdraws from or stops attending a normal class, club, workshop, or other short-term program after it begins, a refund is not automatically available.

Membership dues, quarterly membership payments, program fees, and similar charges are generally nonrefundable after the applicable membership term or program begins except when the Society approves an exception because of serious or extenuating circumstances.

In determining whether a refund, credit, waiver, or exception is appropriate, the Society may consider factors including:

  • Reserved participant capacity
  • Instructor commitments
  • Materials already purchased
  • Expenses already incurred
  • Program length
  • Competition commitments
  • Registration commitments
  • Nonrefundable third-party expenses
  • Other circumstances reasonably affecting the Society or remaining participants

Programs involving season-long participation, competition, travel, advancement, or similar commitments may be governed by separate participation and financial policies.

Odyssey of the Mind is governed by its separate Family Participation Agreement and Withdrawal & Financial Commitment Policy.

Nothing in this section limits any refund, cancellation, or consumer right that cannot lawfully be waived.

16. Removal From Programming

The Society may restrict, suspend, or remove a participant when reasonably necessary because of:

  • Serious or repeated Code of Conduct violations
  • Significant safety concerns
  • Deliberately unsafe behavior
  • Threats, serious harassment, or violence
  • Repeated refusal to follow safety instructions
  • Serious misuse of tools or equipment
  • Failure to comply with significant program requirements
  • Other circumstances that make continued participation unsafe or impracticable

When appropriate, Society leadership will attempt to communicate with the participant and family and address concerns before removal.

Immediate action may be taken when reasonably necessary to protect the participant or others.

Any refund or continuing-payment obligation following removal will be determined according to the applicable membership or program-specific financial policy and any rights provided by law.

17. Transportation

This Family Participation Agreement does not provide blanket permission for Society transportation.

Transportation of a minor by or on behalf of the Society requires separate parent/guardian authorization.

Families will receive information concerning applicable transportation arrangements before being asked to provide permission.

18. Overnight Activities

This Agreement does not authorize independent overnight supervision by the Society.

Under the Society's current policy, overnight youth activities are family-attended unless the Board later adopts specific procedures permitting another arrangement.

Parents/guardians remain responsible for their children overnight during family-attended events.

19. Family Responsibilities

Parents/guardians agree to:

  • Provide accurate registration, emergency, and safety information.
  • Keep contact and authorized-pickup information current.
  • Inform Society leadership of information reasonably necessary for their child's safe participation.
  • Review program-specific requirements before enrollment.
  • Communicate respectfully with Society participants, families, instructors, volunteers, and leadership.
  • Pay agreed membership and program fees according to published terms.
  • Help their child understand and follow Society safety expectations and the Member Code of Conduct.

20. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

21. Governing Law

This Agreement will be governed by the laws of the State of Texas.
